Paulding County Man Sues WellStar for Medical Malpractice

Man sues Georgia’s largest health system, WellStar. The Paulding County man resident says he was misdiagnosed by staff at the Hospital in Marietta.

Damien Robinson sought emergency treatment at the hospital back in March 2018. In his medical malpractice lawsuit which was filed on November 6 in the DeKalb County State Court, Robinson claims he received subpar care and ended up with serious permanent injuries.

He is suing the health system, the hospital, and two of its staff members for at least $10,000 in damages as well as legal costs.

The lawsuit claims that Robinson went to the emergency department in the middle of the night on March 6, 2018. The then 18-year-old reported chest pain, sensory loss, numbness, weakness, and urinary retention.

He was seen at 1:45 a.m. by emergency department doctor Richard Kleiman who ordered an MRI scan of Robinson’s spine. According to the lawsuit, the doctor didn’t ask for a contrast MRI in which the scan would be clearer. The lawsuit claims that a contrast MRI was necessary.

Robinson said the on-call neurology doctor relayed information to neurologist James Armstrong for a consultation and physician assistant Elizabeth Bleakley helped Armstrong in the consultation.

The plaintiff claims neither ordered a full spine MRI with contrast but they instead opted for a lumbar MRI.

Robinson says Armstrong and Bleakley incorrectly diagnosed him with conversion disorder. This is a mental condition in which a person experiences blindness, paralysis, and other nervous system problems that can’t be explained physically.

The lawsuit says Robinson was later diagnosed correctly with spinal cord inflammation. It claims this was a more likely cause of his symptoms and Kennestone’s medical team should’ve investigated it.

Robinson claims his condition went untreated for days and this caused serious, permanent harm that should have been avoided by proper medical analysis.

WellStar disputes Robinson’s claims.
